"Making it a federal case": a model for indigent representation

Article Abstract:

The Federal Defender Division of the Legal Aid Society in New York provides a model for the representation of poor clients. The FDD, in contrast with the state's Criminal Defense Division, enjoys a funding structure under the federal Criminal Justice Act that ensures high-quality legal representation defendants relatively free of political interference. FDD attorneys are treated as respected professionals and their independence is assured by the Judicial Conference, the adminstrator of the Criminal Justice Act.

"A riddle wrapped in a mystery inside an enigma": general personal jurisdiction and notions of sovereignty

Article Abstract:

Issues involving the Supreme Court's test for general personal jurisdiction are discussed. Issues include the test's lack of clarity, gaps in the existing doctrine, the differences between general and specific personal jurisdiction, the difficult about what the Court means by 'sovereignty,' and the need for adopting a better test.
