Navigating the STAA: a survey and recent developments under the anti-retaliation provisions of the Surface Transportation Assistance Act
Article Abstract:
The Surface Transportation Assistance Act (STAA) provides for grants to states for programs which enforce federal and compatible state safety standards for commercial cars and trucks. The whistleblower provisions of the Act are in Section 405 and hope to encourage reporting noncompliance with these standards. Congress felt that transportation industry employees could best determine such noncompliance and wrote this section of the law to protect them should they be threatened with dismissal for cooperating with enforcement agencies. Complaints under Section 405 will probably increase.

Distinguishing refusal to consider from refusal to hire
Article Abstract:
The National Labor Relations Board needs to clarify its policy on remedies for employers who refuse to consider union members for hire. For example, the 4th Circuit remanded Ultrasystems Western Contractors v. NLRB, criticizing the Board for adopting a position that the case involved a refusal to hire instead of refusal to consider. Typical remedies consist of back pay following reinstatement, or reconsideration and appropriate hiring.
