Article Abstract:
Concern for alcohol abusers and their efforts to recover from their illness should be included in attorney disciplinary proceedings. Substance abuse is a factor that affects attorney performance, and attorneys in recovery can competently provide the public with legal services. Disciplinary bodies should integrate recovering alcoholic lawyers into their panels to ensure that decision-makers are informed on alcohol abuse issues.

Article Abstract:
The District of Columbia and many other jurisdictions consider alcoholism and rehabilitation mitigating factors in assessing lawyer misconduct. DC disciplinary chair Hamilton Fox III finds the drawbacks of this mitigation outweigh the advantages, with some lawyers claiming to be alcoholics to seek leniency. The disciplinary system should operate with protection of the public as a higher priority than protection of attorneys.
