Organizational justice: recognizing and rewarding the good citizen corporation

Article Abstract:

Effective and detailed compliance programs are necessary to identify corporations making reasonable efforts to comply with the law and to reward corporations having such programs. Corporations indicted for crimes but which have compliance programs should be allowed to present evidence of such programs tp rebit the prosecution's case. There should also be a due diligence defense to corporate criminal liability, and prosecutors should have guidelines enabling them to focus their resources on the worst corporate offenders. Agency principles can provide a tool for distinguishing between effective and ineffective compliance programs.

Participatory management within a theory of the firm

Article Abstract:

Economists could analyze participatory management as a way of adapting to the economic changes that have affected the corporate functions once performed by hierarchical bureaucracies, that is, monitoring firm agents and transmitting information. Participatory management can provide a new way of impacting the information distortion caused by too many bureaucratic layers and fulfilling the social function of monitoring employees. These two possibilities are complementary and if correct, obviate the economic need for government intervention.

Privately ordered participatory management: an organizational failures analysis

Article Abstract:

Participatory management (PM) has been touted as a means of enhancing productivity, but has been little studied as to in which firms it might be successful. An examination of its use reveals that PM's use has sometimes caused hierarchical redundancy, but offers an information distortion solution. It can also provide means for employee monitoring.
