Outsourcing software overseas; foreign developers offer savings so long as risks are minimized
Article Abstract:
Software developers may be able to save money by using foreign outsourcing, but must have carefully drafted software development agreements to minimize the risks involved. These risks are the cultural and geographic problems of having technological work done in developing countries. The agreement should contain software development-specific terms, including a definition of the programs to be developed, a timetable for delivery, procedures for testing before the programs are acceepted, the expected cost of the development and similar provisions. It is also possible to have the work done through a US management firm but this will not save as much money as the direct approach.

Y2K remediation raises copyright fair-use issues; companies modifying software as part of Y2K compliance can reduce risk of infringement
Article Abstract:
Selling copies of computer software which has had Year 2000 remediation may raise fair-use problems. A private, noncommercial year-2000-compliant software upgrade would not supplant a commercially valuable right to make and sell such an upgrade and would therefore be consistent with a fair-use determination. If the copyright owner makes such an upgrade, on the other hand, the company's arguments for fair use would hold less water. A fair use argument conducted exclusively with in-house employees will be the most persuasive.
