Prosecutorial discretion
Article Abstract:
Observers suggest that federal agencies should exercise prosecutorial discretion when enforcing regulatory measures. They claim that the Federal Trade Commission is one agency that needs to exercise said discretion. For years, FTC has enforced and ruled indiscriminately on consumer protection and antitrust cases only to be reviewed and reversed by the Supreme Court. They added that a case-to-case enforcement may be more effective and prudent relative to upholding public interest.
