Pyrrhic victory in spectrum auction: the FCC's plan to favor small businesses through its C Block auction has resulted in a need for major corporate restructuring
Article Abstract:
The FCC's sale of the C Block spectrum to Personal Communications Services (PCS) in Dec 1996 may spark a spate of PCS bankruptcies unless the agency helps the industry restructure to pay off the debts incurred by the auction. The bids totalled over $10 billion and few PCS firms have been able to raise enough money to both pay off the FCC and fund start-up operations. Attempts by PCS firms, which are mostly resource poor, to issue securities that would finance debt repayments and capitalize their businesses have failed. The industry may yet recover if the FCC allows PCS firms to reorganize their debts.

Malpractice; assignment of claims
Article Abstract:
The courts have started looking to public policy in ruling on the assignability of professional malpractice claims, and this non-traditional approach has generally led them to bar assignments. About two-thirds of the jurisdictions that have addressed the issue bar assignments of legal malpractice as against public policy. The courts have perceived the free assignability of malpractice claims to threaten the attorney-client relationship.
