War crimes suits on tap in NYC; rights group served alien tort papers on Serb chief Radovan Karadzic
Article Abstract:
Complainants against Radovan Karadzic, self-styled president of the Serb Republic, hinge on the Alien Tort Claims Act, which gives federal courts jurisdiction in disputes between alien states and individuals. Revival of the act, which in 1789 was still meant for adjudicating disputes on the high seas, began with the 1980 case Filartiga v. Pena-Irala, in which a Paraguay resident tracked down in Brooklyn a policeman who had killed his son. The Karadzic actions, Doe I v. Karadzic and Kadic v. Karadzic, are pending in the Southern District of New York.

CFTC shouldn't license the press
Article Abstract:
The Commodity Futures Trading Commission's (CFTC) regulations requiring for-profit publishers of commodities advice or analysis to register as commodity trading advisers violates the First Amendment protection of the press. Such regulations constitute prior restraint, as the US Supreme Court ruled in the 1985 Lowe v. Securities case. The Chicago Commodity Trend Service Inc and the Institute for Justice sued to challenge the CFTC's regulations, but the Chicago Commoditiy's suit was dismissed as not ripe for review.
