Article Abstract:
Defined benefit plans will become more importance because of the aging US population. About 103 million people are either approaching retirement or soon will be. That too few have retirement plans or are saving enough on their own underscores the importance of defined benefit plans. However, the existing system is deteriorating and must be reformed. Reforms must make funding predictable, lower administrative costs and combine the best features of defined benefit and defined contribution plans.

The Mackay doctrine: much more than mere dicta
Article Abstract:
The Supreme Court's 1938 ruling in National Labor Relations Board v. Mackay Radio & Telegraph Co. that employers permanently replacing striking workers did not violate the National Labor Relations Act has never been overturned, and the doctrine still stands in spite of executive and legislative attempts to overturn it. Mackay reflects the Supreme Court's understanding that employers must be able to hire permanent replacement workers to ensure continued growth of the US free market economy.
