Resolving mass tort claims: the perspective of a special master
Article Abstract:
The reflections of a special-settlement master whose function is to help the parties and the courts resolve the dispute and develop a workable settlement vehicle for dispensing the settlement funds to eligible claimants are given. Helping the parties fashion a workable settlement vehicle is potentially the more challenging part of the mission. Voluntary mediation is probably, on balance, more effective than that ordered by the courts, since the parties themselves have decided on the wisdom of its use.

Debate; the role of ADR in mass torts
Article Abstract:
The experts debating the issue at Georgetown University Law Center's second annual Mass Tort Litigation Institute Program reached a consensus that shortcuts in the judicial system were necessary but did not want these to deprive people of their fundamental rights. Individualized justice is necessary rather than one grid which governs everything.

ADR recommendations for mass torts
Article Abstract:
An American Arbitration Assn task force issued recommendations in Mar 1997 for ADR with mass torts. Recommendations included using ADR procedures as an initial step and involving insurance companies in research. They also include using ADR administrative techniques to evaluation claims and ADR procedures after tort action is initiated.
