SEC's valuation views may have impact

The Securities and Exchange Commission (SEC), responding to problems with unrealized losses not being reported in the portfolios of financial institutions, has urged the Financial Accounting Standards Board (FASB) to move toward market-value standards for investment portfolios. As a partial step, FASB issued a rule requiring all companies to list in a footnote the fair market value of the financial instruments they hold. The SEC's recent issuance of two cease-and-desist orders over accounting practices indicates that an aggressive approach will be taken in the future to enforce rules.

Securities litigation bills are anti-market
Article Abstract:
The securities reforms proposed in Congress as part of the Contract With America would hurt investors and run counter to the stated intent of the legislation. They would restrict investor lawsuits, which are critical to the cost-effective operation of the markets; weaken shareholder protections by protecting bad-faith forecasts; and reduce the role of the SEC at a time when it needs more scope and funding. These changes will ultimately make our market less attractive to all investors.

Defending the SEC from 'deregulators.'
Article Abstract:
The Securities and Exchange Commission was exempted from the Jan 28, 1992 White House moratorium on further government regulation. The SEC, with its emphasis on mandatory disclosure, has made the US securities markets respected worldwide and the concepts of US securities regulation have been adopted in major industrial countries. Increased criticism of the SEC has been noticeable of late and critics should keep these achievements in mind.
