An introduction to special antitrust issues in health care provider joint ventures
Article Abstract:
There are specific antitrust questions for joint ventures in the health care industry. One question involves patient sourcing, in which the potential exists for improper referrals. Another question concerns ancillary restraints for managed care organizations which are controlled by a combination of doctors and hospitals. Those who are excluded from the arrangement can claim that a group boycott is in effect.

A framework for antitrust analysis of health care joint ventures
Article Abstract:
Joint ventures in the health care industry must consider antitrust questions of purpose, integration efficiency and market power. A venture for the purpose of improved bargaining with third parties on prices is highly suspect for antitrust, as is one which excludes competitors. Joint ventures for buying or which do not have an economic output are not suspect.
