Silicone implants - tolling of the statute of limitations
Article Abstract:
Plaintiffs suing manufacturers of defective silicone breast implants can avoid the usual one-year-after-knowledge-of-the-injury statute of limitations for products liability claims by pursuing a fraudulent concealment cause of action. Under this theory, the statute of limitations does not begin to run until plaintiff discovered or could have discovered defendant's intentional concealment. This cause of action serves injured plaintiffs well because the breast implant industry's false assurances about the safety of implants made many plaintiffs miss the products liability statute of limitations.
