State-sponsored growth management as a remedy for exclusionary zoning

Article Abstract:

State growth management plans can provide the most comprehensive remedy available for exclusionary zoning. Oregon's statute creating a Land Conservation and Development Commission is the leading example of the statewide growth management approach, which offers a politically feasible way of planning for affordable housing. The alternatives of judicial remedies or state anti-exclusionary legislation are less likely to be effective. The judicial approach, exemplified by the Mt. Laurel decisions in New Jersey, is costly and tends to be piecemeal, while anti-exclusionary legislation is difficult to enforce.

The exclusionary suggestion? Conservative legal grooup fighting lonely battle to buffedr Miranda's force

Article Abstract:

Attorneys from the Washington Legal Foundation use 18 USC 3501 to argue that the Miranda rule is not a constitutional right. The law states that courts should weigh a number of factors in deciding whether statements made during police questioning are voluntary and that the Miranda rule is just one of these factors. The foundation's reasoning is that since the Supreme Court consistently describes Miranda as giving prophylactic, non-constitutional safeguards, Section 3501 is not unconstitutional.

Drug war battle fatigue

Article Abstract:

The misguided attempt of labeling the anti-drug efforts a war is described. Wars must have winners and losers and the country is headed toward the dispiriting knowledge that theree can be no winner because theree is no single enemy. The only hope is a collective adaptation of attitude.
