Substituted judgment: medical and financial decisions by guardians
Article Abstract:
Guardians and conservators can make decisions on health care and money for their incapacitated wards or conservatees under the substituted judgment doctrine. However, laws change from state to state, with applicability based on varying and diverse standards of "best interest" or "intent." In some situations, the doctrine may permit conservators to transfer assets or make estate and tax planning decisions, although a number of state courts have limited this ability. A survey of state legislation based on the doctrine is included.

Money laundering, financial fraud, and technology: the perils of an instantaneous economy
Article Abstract:
An international subregime for finance is needed to deal with the increasing prospects for money laundering and fraud as the global economy develops. Crime will increase for credit cards, commodity transactions, teller machines, electronic transfers and secondary market trades. Growing countermeasures include improved audit trails, non-bank regulation, border monitoring of cash, and attention to customers and large transactions.
