The Family and Medical Leave Act of 1993: a comparative analysis with Germany
Article Abstract:
Comparisons of family and medical leave legislation in the US and Germany indicate that foreign models are of limited value in forecasting the effects of new legislation because of differences in social ideology, coverage and purpose. The German laws were enacted in a society in which social policy legislation has a long history. The US experience is one that values independence and individualism. These differences colored the laws enacted. The US Family and Medical Leave Act of 1993 provides rights to employees but does not require paid leave, consistent with societal differences.

Regulation of exchange-traded and OTC derivatives: the need for a comparative institution approach
Article Abstract:
Congress should pass legislation directing the Commodity Futures Trading Commission (CFTC) to grant futures exchanges exemptions from some of their regulations. The reasons for exemption are the ability of futures exchanges, with some assistance from the CFTC, to keep the market honest themselves and the fact that regulation itself is expensive and imperfect. Regulators are only mortal and do not necessarily do the best job possible.

Too healthy to sue under the ADA? the controversy over pre-offer medical inquiries and tests
Article Abstract:
Case law covering the Americans with Disabilities Act's prohibition on pre-employment medical inquires and tests is discussed. Court rulings in some circuits that allow non-disabled applicants to sue under the law are analyzed.
