The "professional expert" witness: Doctor Lichtor, I presume?
Article Abstract:
Professional expert witnesses, such as Missouri independent medical examiner Dr. Joseph Lechtor who testified in numerous personal injury and workers' compensation cases during the 1980s and 1990s, hurt the judicial process by presenting junk science and biased testimony. Prejudicial expert testimony usually aids insurer-defendants and often prolongs litigation. Expert witnesses generally enjoy immunity, but they may still be liable for negligence and such liability for malpractice may prove to be best way of controlling this type of witness abuse.

Emotional distress: how I learned to stop fearing toxic torts and to sue for the fear
Article Abstract:
The availability of emotional distress tort claims has been increasing, as demonstrated by recent toxic tort case law. Fourteen states no longer require a physical injury claim to accompany a negligent infliction of emotional distress claim, and 12 more states only require a physical impact or contact. Emotional torts related to toxics exposure are based on fear of cancer, increased risk of future disease, harm to quality of life, increased susceptibility to disease and increased costs to check for future harm.
