Jurisprudence of the Foreign Claims Settlement Commission: Iran claims
Article Abstract:
The terms of the lump sum settlement for US nationals' claims under the Iran Claims Act fell under the jurisdiction of the Foreign Claims Settlement Commission. The Commission's jurisprudence in this matter was based on a combination of constraining legal sources which led to several contradictory decisions in its interpretation of Iran-US Claim Tribunal case law and other matters. On the other hand, the Commission's innovative approach to questions of international state responsiblity may have a lasting impact.
