The predictability of punitive damages awards in published opinions, the impact of BMW v. Gore on punitive damages awards, and forecasting which punitive awards will be reduced
Article Abstract:
The author examine statistics on compensatory and punitive damages in cases which lead to published judicial opinions following the US Supreme Court's decision in BMW of North America, Inc. v. Gore. Results indicate no significant differences in punitive damage reductions and that trial level awards can be used to predict judicial review of punitive damages outcomes.
