A California court's agreeing with an applicant for a .biz domain name that the selection process for contested names may qualify as an illegal lottery under California law is discussed. State courts don't have jurisdiction, because 50% of .biz applicants are non-US citizens and thus not subject to US laws, according to ICANN.

The elements of the Anticybersquatting Consumer Protection Act of 1999 are outlined, and suggestions are made for amending the law to cover the initial confusion of consumers searching for a trademark owner's site who find themselves directed to the wrong site.
