Treasury/IRS issue list of 1997 priorities for tax regulations and other administrative guidance
Article Abstract:
The US Department of the Treasury and the IRS have released their list of 1997 regulatory and administrative priorities. Many of the initiatives noted that relate to employee benefits are in response to the passage of the Small Business Job Protection Act and the Health Insurance Portability and Accountability Act in 1996. The actions planned include issuance of revenue procedures, proposed regulations, announcements, notices, revenue rulings and other forms of IRS guidance.

State law claim against excess benefit plan sponsor fails where plan administration was tied to ERISA administration
Article Abstract:
A federal district court ruled in Farr v US West, Inc that excess benefit plans' exemption from ERISA coverage did not apply when the plan's administration is connected with that of a related ERISA pension plan. This also meant plaintiffs could not use state law as a basis for suits regarding the plan.
