Article Abstract:
The homogenous sense of the legal profession and the widespread belief in the law as an abstract truth to which lawyers had special access reached their apex in 1960. Several factors combined to create a faith and attitude among lawyers similar to that expressed by the clergy of the medieval church, that by special training their guild had achieved a certitude of knowledge not available to the common man. Now there is much less faith in the idea of an objective law capable of routinely approaching true justice.

Defending securities fraud class actions in state courts raises many procedural and substantive issues different from those being litigated in federal court
Article Abstract:
Filing securities fraud class actions in federal and state jurisdictions can make a difference in various procedural matters. These can include the resolution of jurisdictional matters such as whether the court may certify and bind multistate classes; in the kind of claims which can be asserted; in the procedure for class certification; in the discovery permitted; and in the award of legal fees. Lawyers should never assume that state class actions will mirror the federal version.
