Under construction: LatCrit consciousness, community and theory
Article Abstract:
LatCrit, or Latino-focused critical legal scholarship, is an evolving area. Four essential functions needed to validate this type of scholarship are: knowledge production, expansion of Latino struggles, advancement of transformation, and development of Latino-based community connections and coalitions. Latino critical race theory and legal scholarship will have to be informed by the language of race in order to become viable. This will be increasingly true as Latins move towards becoming the largest US minority group, and the country itself moves towards a non-white majority.

Race, ethnicity, erasure: the salience of race to LatCrit theory
Article Abstract:
The Hernandez case examplifies the continuing importance of race as an element in the development of Latino legal scholarship and critical race theory. Mexican-American racial identity is the focus of the US Supreme Court decision, which extends 14th Amendment protections to Latinos for the first time. Latino critical race theory and legal scholarship will have to be informed by the language of race in order to become viable. This will be increasingly true as Latins move towards becoming the largest US minority group, and the country itself moves towards a non-white majority.

Rodrigo's eleventh chronicle: empathy and false empathy
Article Abstract:
People of color should abandon appealing to whites for empathy regarding justice issues because the the different experiences of different racial groups preclude the effective operation of empathy. Empathy does operate in the justice system, but it typically does so to offer leniency to professional and suburban whites. This false empathy can be undone by rejecting the role it plays in the legal system. Sympathetic whites can also undermine these biases by becoming a race traitor or addressing working-class whites that have been pitted against people of color.
