Who's failing whom? A critical look at failure-to-protect laws

Article Abstract:

The author examines statutes under which parents or caretakers can be charged with failing to prevent another person from abusing children in their care. Cases holding live-in boyfriends liable for failure to protect are discussed and gender stereotypes are used to explain why women are held liable for such failure more often than men.

Article Abstract:

The author traces trends in professional responsibility rules for attorneys and calls for the addition of default rules and opt-in rules by bar associations. He proposes the adoption of aspirational rules to aid enforcement of ethical norms and suggests that law firms adopt codes of professional responsibility.
