With the tuna-dolphin controversy expected to resurface, Congress faces a catch-22: compliance with GATT provisions could infuriate the 'green' lobby
Article Abstract:
The US is having trouble with its dolphin protection programs which call for primary embargoes on importing tuna from countries that do not limit purse seine fishing because the programs violate the GATT. Congress must chose between complicating international trade talks and angering the strong US environmental lobbies. The Inter-American Tropical Tuna Commission is seen as successful in helping preserve dolphins that are often killed in the process of catching yellowfin tuna using purse seine fishing but many Congress members believe the embargoes are still necessary.

The GATT, U.S. law and the environment: a proposal to amend the GATT in light of the tuna/dolphin decision
Article Abstract:
A recent decision held that US trade restrictions against tuna imported from Mexico, restrictions intended to protect dolphins, were incompatible with GATT. The decision shows the need for an amendment to GATT to allow trade restrictions based on bilateral or multilateral environmental agreements. This approach would be preferable to the US's current practice of enacting unilateral trade bans, which conflict with international law.

GATT and the fair wage: a historical perspective on the labor-trade link
Article Abstract:
Labor standards based on human rights were not an original feature of the General Agreement on Tariffs and Trade, predecessor to the World Trade Organization. In order to include this principle, the relationship between such standards and wages should be investigated and developing nations should be able to participate in discussions.
