Ban on 'virtual' pornography upheld
Article Abstract:
The First Circuit Court of Appeals, in United States v. Hilton, ruled that the federal Child Pornography Prevention Act did not violate the First Amendment by banning computer-generated child pornography and pornography showing adults who appear to be minors.The court held further that the Act's ban on expression based on content was justified by a compelling government interest in preventing child pornography. The court stated that the Act applies only to images that are virtually indistinguishable from un-retouched photographs of children engaging in identical sexual conduct.

'Tough law' stings journalists - as predicted
Article Abstract:
A less publicized part of the Child Pornography Prevention Act would amend the Privacy Protection Act of 1980, enacted by Congress after the Supreme Court's ruling in Zurcher v. Stanford Daily that newsrooms have no First Amendment protection from police searches. Journalists groups urged Congress that various professionals whose legitimate research materials included alleged child pornography would be at risk and although Sen Orrin Hatch stated the law would be clarified, this was never done.
