City ban on commercial speech in subways upheld

The New York Court of Appeals ruled that the New York City Transit Authority could restrict commercial activities within the subway because commercial activities could interfere with the subway's purpose of transportation. The case involved a member of the Socialist Workers' Party who had been selling newspapers and promoting his party candidates for the October 1993 state election. The Court denied both the contention that the activity was not commercial and that the subway was a public forum.

Publishers face arrest to distribute magazines
Article Abstract:
Alternative sports magazines have faced court battles to be allowed to market their wares on public sidewalks outside sports stadiums. The cities in question, including Denver and Chicago, have claimed that attempts to stop salesmen were enforcements of municipal ordinances banning huckstering. The newspaper vendors have claimed violations of their freedom of speech. Denver officials agreed to let sales of the alternative newspaper continue, while the Chicago case is under appeal.

Transportation authority wrongly removed magazine ads from buses
Article Abstract:
The US 2nd Circuit Court of Appeals ruled in New York Magazine v. New York Metropolitan Transportation Authority that the Transportation Authority had no right to remove an advertisement for New York Magazine from its buses. The ad claimed the magazine was the only positive aspect about New York that Mayor Rudolph Giuliani could not credit himself for. Giuliani sued for violation of privacy. The Court ruled the venue provided protected commercial and political speech.
