Cable operator can charge fee for non-local programming
Article Abstract:
The US Court of Appeals for the 5th Circuit ruled in Horton v. City of Houston that a local cable management company could promote localism in programming by levying fees for programs produced outside Houston but that the fees collected must also be used for local programming. The court ruled that the fees collected represented an unconstitutional burden on free speech if they were not used for promoting localism, the purpose for which they were collected.

Execution coverage limits exceed prison authority
Article Abstract:
The Oregon Supreme Court ruled in Oregon Newspaper Publishers Ass'n v. Oregon Department of Corrections that State Department of Corrections rules limiting the portion of executions the press could see and report on were invalid because they exceeded the department's regulatory authority. The court, however, declined to decide whether the rules were unconstitutional limits on free speech under the federal and state constitutions.

The US Court of Appeals for the 9th Circuit ruled in Klamath Water Users Protective Ass'n v. Department of the Interior that records between the department and the tribes were not internal agency records and did not qualify for exemption under the Freedom of Information Act.
