Coors wins right to display alcohol content; ban on beer label disclosure violates brewer's speech rights

The US Supreme Court ruled in Rubin v. Coors that the government interest in restricting strength wars among beer manufacturers was substantial but that laws banning brewers from placing alcohol content information on their labels did not directly advance this interest. The labels were commercial speech warranting First Amendment protection because the information was truthful and not misleading. The Court noted that other forms of regulation would more effectively address the concern that brewers would compete for consumers based on alcohol content.

FDA issues rules restricting tobacco advertising
Article Abstract:
The US Food and Drug Administration has issued guidelines restricting tobacco advertising that may reach children, following its announcement that it has the authority to regulate tobacco because it is a drug. The regulations limit sponsorship of events by tobacco manufacturers, ban outdoor advertising of tobacco products near schools and playgrounds, and ban sales or giveaways of merchandise that displays tobacco products. Industry groups have opposed the regulations based on commercial speech protections.
