Fresno takes newspaper to court to stop deliveries

A California appellate court ruled in Fresno v. Press Communications that the city of Fresno's ordinance restricting distribution of free newspapers and other materials was unconstitutional on its face. The city had argued that the ordinance was content-neutral, but the court characterized it as content-based because only certain types of publications were subject to the law. The city had argued that the ordinance restricting distribution of unauthorized newspapers served the city's interest in crime and litter prevention.

Appeals court overturns ban on distribution of novel
Article Abstract:
The US Court of Appeals for the 6th Circuit ruled in In re HarperCollins Publishers, Inc that a district court judge had erred in trying to prevent distribution of a true crime book with a jacket which family members contended exploited their dead loved one's 'right of publicity.' The mandamus procedure used by HarperCollins to have the original order overturned was ruled correct. The court also stated that any interference with First Amendment rights could not be countenanced.
