Court allows use of unpublished work
Article Abstract:
The US Court of Appeals for the 2d Circuit has ruled that copyrighted unpublished materials are usable if their usage meets the Copyright Act's fair use criteria. The Copyright Act of 1976 determines whether the use of copyrighted materials is fair by the purpose and character of how the material is used, the nature of the material, the amount quoted from the material, and by what effect the use will have on the future marketing of the material. In Wright v. Warner Books Inc, the court stated the author met the law's criteria.

Court protects raw footage used in news stories
Article Abstract:
The US Court of Appeals for the 9th Circuit has ruled in favor of the Los Angeles News Service (LANS), in LANS's copyright case against Audio Video Reporting Services (AVRS), a video clipping service. The court has agreed that LANS's news film is copyrightable and AVRS's use of LANS's film is an unfair use in their market. The court also rejected AVRS's argument that the court should force LANS to agree to a licensing agreement, stating it was not the court's business to interfere with the business of the two companies.

Parody of magazine photograph ruled a 'fair use.'
Article Abstract:
The US Court of Appeasls for the 2d Circuit ruled in Leibovitz v. Paramount Pictures that a parody of the 'Vanity Fair' photograph of a nude, pregnant Demi Moore was a fair use of the copyrighted work. The court held the amount of the original used in the parody not to be a significant factor in deciding if that parody was a fair use.
