Court upholds dismissal of HIV-positive man's privacy suit: two judges find the 'disclosure of private facts' tort is not recognized in the state
Article Abstract:
The Indiana Supreme Court upheld a Superior Court's summary judgment in favor of one of four defendants in a suit filed by an HIV-positive man against a hospital for revealing his HIV status. The HIV-positive man revealed his status in an ambulance while he was enroute to a hospital. A hospital worker subsequently revealed the status to her husband, who worked with the patient. The husband revealed the status to other coworkers, including Cathy Duncan, who mentioned it to two others. The Supreme Court ruled that Duncan's revelation to only two people did not amount to publicizing the fact.

Dismissal of TV talk show privacy claim upheld
Article Abstract:
The US Court of Appeals for the Seventh Circuit ruled in Howell v. Tribune Broadcasting that a teenager appearing on the "Charles Perez Show" failed to state a claim for invasion of privacy. She argued that airing a show in which her mother responded to charges against her by revealing the plaintiff's police record and other personal facts constituted an invasion of privacy. The court found that she had consented to the broadcast by appearing on the show and not objecting at the taping. The court also found that the disclosure was not highly offensive.
