FDA's efforts to regulate tobacco exceed jurisdiction, court rules
Article Abstract:
The US 4th Circuit Court of Appeals' Aug 1998 decision in Brown & Williamson v. Food & Drug Administration stated the FDA did not have the right to regulate the sale and advertising of tobacco. The FDA claimed its authority to regulate drugs allowed it to prevent the sale of tobacco to children and prohibit advertising aimed at children. The Court stated Congress had not given the FDA that authority.

Airport vending restriction upheld
Article Abstract:
The US 8th Circuit Court of Appeals ruled in October 1997 that an airport had the right to remove newspaper vending machines from its premises. The Court ruled the airport was a nonpublic forum and could control its own financial interests. The owner of a monthly newspaper serving single people had protested the removal, stating the airport was a public forum that ensured First Amendment rights.
