FOI faces challenge in frightened nation

Article Abstract:

The United States of America is showing the willingness to surrender hard-fought liberties in exchange for some measure of security. People who would cede limitless powers to law enforcement are targeting civil liberties enjoyed by citizens including freedom of information (FOI) that is expected to face a new round of proposals aimed at limiting access to information about the very things the American people need to know about the most.

Disclosure challenges arise in agency files

Article Abstract:

The Empire State Development Corporation New York, objected that 'subpoenas in agency files are court records' and are exempt from disclosure. This objection was raised when a reporter for Newsday wanted to obtain the 'subpoenas as records' contained in the files of an agency as per the procedures set forth in New YorkEs Freedom of Information Law.

Reporters, lawyers and protective orders

Article Abstract:

Leaking information to the press is a very old game and secretaries of State and independent prosecutors still do it. Due to this documents had to be kept in a sealed envelope to be opened only by order of the court, but generally these documents were unavailable to lawyers, journalists and the public.
