Handwritten notes may be agency records
Article Abstract:
The US 2d Circuit Court of Appeals ruled in Grand Central Partnership v. Cuomo that handwritten notes made by government employees may be "agency records" subject to disclosure under the Freedom of Information Act. The U.S. Department of Housing and Urban Development had denied the Grand Central Partnership Business Improvement District access to the notes on the ground that they were exempt from FOIA because they were internal, pre-decisional documents compiled for law enforcement purposes. The case was sent back to a lower court for an examination of how the withheld records might be subject to the Act.

Out-of-court police settlements open, despite confidentiality clauses
Article Abstract:
The Kentucky Supreme Court ruled that the Lexington-Fayette county government could not withhold details of out-of-court settlements because of confidentiality clauses. The county government contended that full disclosure would violate the privacy of the individuals receiving the settlements. However, the Court ruled for the newspaper requesting the information, agreeing that the purpose of the confidentiality clauses was to discourage future litigation. As such, the public right to know about the use of public money had more weight.
