Candidate accused of homophobia loses suit
Article Abstract:
The Ohio Supreme Court ruled in Vail v. Plain Dealer Publishing Co. that a commentary in the Cleveland Plain Dealer's "Forum" section was opinion that was protected from libel charges under the Ohio Constitution. The article was critical of Ohio Senate candidate Loren Loving Vail's views on homosexuality and characterized her as homophobic. The Supreme Court reversed the lower court's ruling that the piece was actionable. The high court found that, under the totality of the circumstances test, the article would be perceived as an opinion piece.
