High court lets separation order stand
Article Abstract:
The Indiana Supreme Court refused to overturn a separation order that barred a reporter from covering a trial because she was subpoenaed to testify in that trial regarding conversations with the defendants. In Indiana ex rel. Labalme v. Madison Circuit Court, the state high court did not recognize the reporter's privilege against compelled testimony, but it did find that the trial court was wrong to claim that it did not have the discretion to remove the separation order. The reporter was called to testify one day after the high court ruling and subsequently was allowed to resume coverage of the trial.

Court finds newspaper can forbid political activism by their reporters
Article Abstract:
The Washington Supreme Court found in Nelson v. McClatchy Newspapers that a reporter's claims under the Fair Campaign Practices Act would have had merit but applying the law to her employer, the Tacoma News Tribune, would be an unconstitutional abridgement of the newspaper's free press rights. The reporter was transferred and sanctioned for her involvement in political activism. The newspaper argued that it had a right to protect its perceived objectivity and could not be compelled to hire or retain any individual as a reporter.

Executive order requires agencies to pursue alternatives to litigation
Article Abstract:
An executive order that President Clinton issued in Feb 1996 requires federal agencies to engage in alternative dispute resolution in all civil litigation cases. This ends a ban on federal agencies' participation in binding arbitration. The order seeks to 'improve access to justice' and speed the resolution of claims against the government, streamline discovery, and make better use of resources. Non-lawyers are to have greater roles in dispute resolution. The Attorney General will issue new guidelines.
