New York high court throws out privacy suit filed over photograph
Article Abstract:
The New York Court of Appeals ruled in Howell v. New York Post Co that a psychiatric hospital patient's privacy had not been violated by newspaper publication of her photograph without her consent. The court based its ruling on the story being newsworthy because the photograph showed Howell and Hedda Nussbaum. The latter is still at the hospital recovering from abuse by Joel Steinberg. Photos which constitute privacy invasions also need to be disguised advertisements, which this was not.

Calendar photograph violated doctor's privacy
Article Abstract:
The New York Court of Appeals upheld the Appellate Division's decision that use of a photograph without the person's consent is an invasion of privacy. The Choices Women's Medical Center had published a calendar promoting its services and highlighting women influential in the women's women's movement. A photograph highlighting one woman identified Dr Cordia Beverley in the background. Beverley sued and was awarded both compensatory and punitive damages.

Court says search, seizure violated federal privacy law
Article Abstract:
The US Western District Court in Texas held in Steve Jackson Games v. Secret Service that the Secret Service violated the Privacy Protection Act of 1980 with a search and seizure at the offices of an electronic bulletin board owner. The Privacy Act forbids the seizure of work product from disseminators of public information, and the court agreed the seized material was work product rather than 'fruits of a crime' as the government contended.
