Prosecutor's 'due process' right overcomes reporter's privilege
Article Abstract:
A California State Court of Appeal upheld a trial court's decision to find a television news station director in contempt of court for refusing to disclose unbroadcasted, nonconfidential interview tapes with an alleged murderer. The Court stated a reporter's privilege encompasses nonconfidential information but conflicting due process rights may be greater than privilege. A prosecutor's right to information is not automatically more important than reporter's privilege, but may be.

The US Court of Appeals for the 3d Circuit ruled in Bartnicki v. Vopper that an illegally taped conversation left anonymously and given to the press could be published and broadcast without violating federal wiretap laws and did not subject the press to liability.
