'Segregate and block' law struck down: cable operators cannot regulate public, educational channels
Article Abstract:
The US Supreme Court found in Denver Area Educational Telecommunications Consortium, Inc. v. FCC that two of three FCC regulations at issue were unconstitutional. The regulations involved indecent programming on leased access and public, educational and governmental access channels. The regulation requiring cable operators to segregate all indecent programming on one channel and block the channel was found to be overly restrictive. The Court upheld regulations that permitted leased channels to refuse indecent programming, but it found unconstitutional a similar regulation for public access channels.

Access denied to privilege hearings and other documents
Article Abstract:
The US Court of Appeals for the District of Columbia Circuit denied access to grand jury documents related to the Bill Clinton-Monica Lewinsky investigation in In re Motions of Dow Jones & Co. The court stated no media access privilege existed for grand jury investigations under common law or the First Amendment. The court noted that redacted transcripts could be made available and ordered a proceedings and documents docket be made available for the news media if they wished to challenge the grand jury's traditional secrecy.

Article Abstract:
Bills introduced into the 102nd Congress regarding freedom of information issues are surveyed. Issues highlighted from the bills surveyed include the striking down of broadcasting bans of indecent materials, local government regulation of the cable television industry, political campaign advertising, information disclosure and prior restraints.
