States look for ways to open more government information: electronic access high on agenda, but privacy concerns close DMV, state worker records
Article Abstract:
A survey of changes in the state laws governing public access to government records reveals that many states are using electronic access and technology to more effectively provide public access, but some are limiting access in response to privacy concerns. California is developing a statewide computer network to provide access, and several other states are creating child abuse and sex offender databases. Some states modified public records laws to restrict access to department of motor vehicles records and allow drivers to opt out of disclosure.

States put brakes on access to driver records
Article Abstract:
Several states are passing legislation restricting the public's access to departments of motor vehicles (DMV) drivers' license records. The major reason usually given for the restrictions is to protect the privacy of licensed drivers, especially after the murder of actress Rebecca Schaeffer in California. Limited access still exists in most states to the press. The restrictions in some states also limit the use of DMV records by direct mail marketers.

Third judge finds federal driver records act unconstitutional
Article Abstract:
US Western District Court of Wisconsin Judge Barbara Crabb joined other federal courts in declaring the Driver's Privacy Protection Act of 1994 unconstitutional for interference with state function. The act prohibits disclosure and uses of driver personal information. Crabb ruled Congress lacked authority to pass the act under the 14th Amendment and that there was no expectation of 4th Amendment right of privacy.
