The government's power to acquire private property by eminent domain has been recognized in America since Colonial times. The Fifth amendment provides that private property shall not be taken for 'public use', without just compensation, but it is found that in many cases, the cash strapped states avoided or paid minimum compensation to landowners whose properties were adversely affected by public improvements.
