Finding the middle ground
Article Abstract:
Alternative Dispute Resolution is becoming a popular means of settling disputes out of court. The process ranges from mediation to independent expert appraisal to arbitration. Australian courts have embraced the idea and are encouraging civil litigants to pursue other means of settling their disputes. The system is voluntary in most states, but in Queensland and Victoria, it is compulsory to use alternative ways of settling a dispute before a case can be heard in court.
