Biology, technology and genealogy: a proposed uniform surrogacy legislation
Article Abstract:
Recent advances in reproductive technology have increased the need for uniform legislation on surrogate motherhood issues. In particular, the availability of gestational surrogacy, in which the surrogate mother has no genetic relationship to the child, has raised new child custody issues. A Uniform Surrogacy Act is proposed in which prenatal intent is recognized as the most important factor. Such legislation would allow prospective parents who would otherwise be unable to have children to enter into surrogacy arrangements with greater confidence in the outcome.
