Article Abstract:

The case of R v Rochdale Metropolitan Borough Council, ex parte Milne gives a valuable insight into issues relating to the practice of seeking outline planning permission where an environmental assessment is involved. In this case, the judge ruled that a generalized description of Kingsway Business Park in Rochdale, England, was not sufficient for the purposes of Schedule 3 of the Town and Country Planning (Assessment of Environmental Effects) Regulations 1988. It appears that it will no longer be possible to establish the principle of the development of a site without providing the detail associated with an application for full planning permission.

The price of rights

Article Abstract:

There are several parts of the Human Rights Act 1998 which will have implications for the British planning authorities. It is likely rights within the convention will be in opposition to how the planning process usually proceeds. Everyone will be given the right to a fair hearing which could result in more public inquires and fewer informal hearings. Planning permission is often granted in favour of the public interest rather than the individual but with the introduction of the act it will be a more complex situation. The Act will be introduced in Oct 2000.
