Article Abstract:

The limits of the duty of protection of neighbouring landowners was a key issue in the case Holbeck Hall Hotel Ltd v Scarborough Borough Council. Here, the plaintiffs claimed damages on the grounds of interference with their right of support to their property and failure to take reasonable action to offer them protection against a hazard of which the defendants were aware. The plaintiffs asserted that the defendants could become liable if their land became a nuisance through no fault of their own and they did not make a reasonable effort to deal with the situation.
