Shocking overheads: valuers are in for a shock if they do not take into account the deleterious presence of electricity power lines when assessing a property

Article Abstract:

The Electricity Act 1989 calls for REC's to have landowners and occupiers consent before the installation of an electric line, as well as consent from the Secretary of State for Trade and Industry. Many power lines over agricultural land were installed under annual wayleave agreements between the REC and the landowner. Easements are usually permanent rights, although a set number of years can be negotiated. The value of a property can be reduced with the presence of overhead electricity lines, and any losses incurred can be compensated by the RECs.

With rising numbers of litigations involving property blight in the U.S., British chartered surveyors are advised to ensure that they have professional indemnity insurance. In particular, surveyors should ensure that they are adequately covered when advising buyers, sellers or lessees of properties close to power lines, which could emit harmful electro-magnetic fields. The options for surveyors considering personal indemnity insurance are discussed.
