The 'Residential Leasehold Reform' consultation paper issued by the UK Dept of the Environment, Transport and the Regions contains proposals designed to make it easier for tenants to purchase their own blocks. Tenants will also have enhanced rights of self-management and greater control of managing agents. These proposals represent a positive development, but problems will continue to arise as long as ownership of blocks is seen as a type of investment. It is now time to move towards a commonhold system of the type already used in many other countries.

A 'doctrine of waiver' is recognised by English law, but to what extent is undefined. According to case law, when legal rights are waived or when legal remedies are waived, the doctrine of waiver is given significance. In the law of contracts, relevance is given to the waiver of legal rights. In the example provided, reference is made to reasonable notice, which is further discussed.
