Article Abstract:

The UK Court of Appeal is not unanimous in its view as to why expert witnesses are immune from prosecution by the party by which they have been retained, with regards to the contents of a report they have prepared for a trial but do not give evidence. There is also disagreement among their lordships about how far this immunity may extend. In the case of Stanton vs Callaghan (1998), Chadwick JL undertook an extensive review of the case law on the immunity granted to both expert witnesses and advocates in relation to their work in the context of litigation.
