Conflicting interests in Timeshare Contracts revisited on the occasion of the ECJ (First Chamber) case C-73/04 judgment 13 October 2005, Brigitte and Marcus Klein v. Rhodos Management Ltd.
Article Abstract:
The astonishing facts related to court decision about a claim of reimbursement of a sum, DEM 2.640 paid in excess and also reimbursement of the total amount paid DEM 15.490 on the grounds that the contract was void is reviewed. It is revealed that the contract was signed in Greece in 1992, which is 13 years before when there was no specific legislation on the acquisition of rights on a timeshare basis in the European Community.

The doctrine of Estoppel protects reliance by a party on the existence of a state of affairs induced by another. Estoppel is poorly understood in South African law, but it has the potential to serve as a vehicle for the development of substantive law in respect of various areas of private and commercial law.
